Donation terms and conditions

 

PLEASE READ THESE TERMS AND CONDITIONS CAREFULLY AND KEEP THEM FOR FUTURE REFERENCE.

 

1. Introduction

 

1.1. West Texas and Plains, whose registered office is at 3115 Cornell Lubbock, TX, operates the on-line donation service in these Terms and Conditions. The Online Services include the collection, processing and transfer of donations, event fees and, where applicable, Gift Aid.

 

1.2. These are the Terms and Conditions, which govern use of the West Texas and Plains. By continuing to use or access the West Texas and Plains Services, or by beginning the registration process, you are agreeing as a minister or organization to be bound by these Terms and Conditions with immediate effect. References in these Terms and Conditions to the ‘Ministers or churches’ or ‘you’ (and similar) are references to you as a ministers or church or other eligible organization that has applied to West Texas and Plains (as defined below).

 

2. Membership of West Texas and Plains

 

2.1. The West Texas and Plains Services are currently only available for use by ministers or churches with a registered address in the USA. 

 

2.2. A non-refundable one-off registration fee of $30 to each applicant will be applied. This is payable by credit or debit card or check. Your contribution to the West Texas and Plains will not (amongst other things) be complete until payment of this amount has cleared.

Organization.

 

2.3. Payments (be they donations or event fees) to you will not be possible or valid before (i) the Charity has completed the registration process and been accepted. 

 

3. Your obligations

 

3.1. The minister and churches must ensure that the content it has posted for display within the West Texas and Plains website, including any links to other websites and the content of linked websites, will not be in violation of any law or regulation or be defamatory, obscene or breach any intellectual property rights of a third party or breach any right of, or duty owed to, a third party.

 

3.2. The minister and churches are responsible for ensuring that all of the details provided in connection with their Account and all of the content generated on the West Texas and Plains website by or on

behalf of the Charity is kept accurate and up-to-date.

 

3.3. The ministers and churches shall at all times comply with all relevant data protection legislation and guidelines.

 

3.4. The Ministers and churches are responsible for its own internal password security control, and for all use of the Account.

 

4. Communications

 

4.1. These Terms and Conditions are issued and concluded in English. Verbal Communication between us will be in English or Spanish and will be conducted by letter, phone or email using the most recent details that you have provided to us. 4.3. Copies of these Terms and Conditions will be available upon request.

 

5. Disclaimer and limitation of liability

 

5.1. Nothing in these Terms and Conditions excludes or limits West Texas and Plains liability for fraud or for any other liability that cannot be lawfully excluded. Except for as set out in these Terms and Conditions, in no event will we be responsible for indirect losses which happen as a side effect of the main loss or damage, and which are not foreseeable by you and us (such as loss of profits or loss of opportunity).

 

5.2. Subject to all reasonable care will be taken by West Texas and Plains but you use the West Texas and Plains website at your own risk and West Texas and Plains is not liable for loss or damage that you may suffer through use of the West Texas and Plains website.

 

6. Termination

 

6.1. The Ministers and churches may discontinue use of the West Texas and Plains Services and terminate its membership at any time. 

 

 

 

7. Confidentiality of your information

 

7.1. Information of a sensitive and confidential nature that you provide to us and we retain about you will not be disclosed to anyone other than:

 

7.1. where we are legally required to disclose or have a public duty to disclose.

 

7.2. where the disclosure is made with your consent; or where the information is already in the public domain other than as a result of us breaching our confidentiality commitments to you.

 

7.3. to third parties to whom West Texas and Plains are required to disclose this information in order for the West Texas and Plains to be performed.

 

7.5. By using the West Texas and Plains website you accept our use of cookies. Cookies are small text files held on your computer which we use to help us to give customers the best experience possible on our website and to let us understand how customers use our website. Some cookies have already been set. You can delete or block cookies but some parts of our website won’t work without them. 8. Amendments

West Texas and Plains reserves the right to amend these Terms and Conditions and any changes will be notified to you and posted on the West Texas and Plains website at least one month in advance of any such change coming into effect. Your continued use of the West Texas and Plains website following any such amendment will be deemed acceptance by the Charity of the amended terms. It is the ministers and churches responsibility to keep itself appraised of website updates and changes to these Terms and Conditions and you should check these Terms and Conditions whenever you access the West Texas and Plains website.
